“Neighbor Dispute Over Tall Trees Ends in Legal Battle”

A woman in Gourock, Inverclyde, who claimed that her neighbor’s tall trees obstructed her view and affected her property’s enjoyment, has been unsuccessful in her attempt to have the trees cut down. Margaret Glancy, who had retired to her home with plans for a garden terrace, expressed frustration that the 32ft trees owned by Eileen Docherty were blocking the scenic view of the Firth of Clyde.

Glancy argued that the trees were blocking sunlight, hindering plant growth, and preventing her from drying her laundry. She mentioned that the previous owners of the trees had promised her permission to trim the branches encroaching on her property. Seeking resolution, she sought intervention from Inverclyde Council under the high hedge legislation to have the trees reduced in height. Despite her efforts, both the council and the Scottish Government dismissed her appeal.

In her appeal letter, Glancy emphasized that the mixed species tree canopy was impacting her property’s enjoyment, which she had purchased as her forever home in 2018. She clarified that her decision to pay over the asking price was influenced by the picturesque view over the River Clyde, which she now felt was compromised. While she did not request the removal of the mature trees, she urged for management of the offshoots to preserve her view.

In response, Docherty highlighted that Glancy’s concerns had been ongoing, with previous attempts by others to address the foliage height. The council supported Docherty’s stance, stating that the hedge did not unreasonably affect light levels beyond what could be expected by a property occupant.

Government reporter Simon Bonsall ultimately ruled in favor of Docherty, concluding that the trees could remain. He noted that the hedge did not significantly obstruct light to Glancy’s house or garden, despite her desire for a clearer view. Bonsall observed that the outlook from Glancy’s property was not entirely obscured and varied depending on the viewpoint and time of year.
