More than 100 maternity staff from a hospital trust are taking legal action due to exposure to nitrous oxide. A review conducted by the Good Governance Institute two years ago revealed that the Mid and South Essex NHS Foundation Trust was slow to respond to concerns about high gas levels at Basildon University Hospital’s maternity unit. The review concluded that staff faced unnecessary risks.
Despite warnings raised in July 2021, the trust did not take action until October 2022, neglecting the significant health risk posed by the gas levels. Now, staff who worked at Basildon Hospital between 2018 and 2023 are pursuing legal action, reporting symptoms such as fatigue, anxiety, headaches, and cognitive issues.
NHS Resolution has received 141 claims, with some already settled for a total exceeding £89,000, covering damages, claimant costs, and legal fees. While nitrous oxide and oxygen mixtures are considered safe for pain management during labor, prolonged exposure in the workplace can lead to serious health problems, as highlighted by the Health and Safety Executive.
Denise Townsend, the acting chief nursing officer for Mid and South Essex NHS Foundation Trust, expressed regret over the delayed response and emphasized improvements in gas monitoring at Basildon Hospital. The trust has since implemented scavenger equipment to extract nitrous oxide from the air.
Several other NHS trusts have also been identified with elevated levels of nitrous oxide, raising concerns about staff safety and health.
