Wrongly Convicted Victim Calls Out Injustice in Lighter Sentence

Date:

An individual who spent 17 years in prison for a rape he did not commit expressed feeling insulted that the actual perpetrator received a lighter sentence. Paul Quinn, aged 52, was incarcerated for 24 years for a brutal assault on a young mother in July 2003. Andrew Malkinson was wrongly convicted of the crime a year later and was exonerated in 2023 after a prolonged advocacy effort.

Mr. Malkinson characterized Quinn as a “despicable individual” who caused immense suffering to both the victim and himself. He voiced his dismay over Quinn receiving a milder sentence despite letting him endure over 17 years of wrongful imprisonment. Malkinson, who served a life sentence, highlighted Quinn’s history of violence and sexual offenses, expressing hope that Quinn would not get parole and serve a longer term for justice to be served.

Additionally, Mr. Malkinson’s lawyer, Toby Wilton of Hickman & Rose, emphasized that while his client is relieved by the closure of this chapter, he continues to advocate for a fair compensation scheme for victims of miscarriages of justice. Wilton criticized the current system that deducts costs from compensations, disproportionately affecting victims like Mr. Malkinson who have suffered greatly.

The victim of Quinn’s heinous crime, acknowledged as a hero in court, expressed a mix of emotions after 20 years, stating that while justice has been served, the impact on two lives remains profound. She shared the enduring psychological and emotional toll of the traumatic event, highlighting the constant fear and lasting effects on her and her family.

Following Quinn’s sentencing, law enforcement authorities urged potential additional victims to come forward, suspecting Quinn’s involvement in other serious sexual assaults. Detective Chief Superintendent Rebecca McKendrick condemned Quinn’s actions, emphasizing the importance of seeking justice for all victims affected by his crimes.

Quinn’s trial revealed the horrific details of the attack on the mother-of-two in Greater Manchester, leading to his conviction for rape, GBH, and attempted suffocation. The judge commended the victim for her courage and resilience throughout the trial, emphasizing the severity of the crimes committed by Quinn and the impact on both the victim and the wrongfully accused.

Moreover, the investigation into the mishandling of the case and the delayed identification of Quinn as the perpetrator has raised questions about the initial focus on Mr. Malkinson and the failure to conduct thorough forensic examinations earlier. The Independent Office for Police Conduct is scrutinizing former officers for misconduct, shedding light on the flawed handling of the case.

Quinn’s eventual admission of guilt based on DNA evidence from the victim’s clothing marked a turning point in the case, highlighting the critical role of forensic analysis in securing justice. The revelation of Quinn’s DNA on the victim’s clothing after years of legal battles underscored the necessity of a thorough review of evidence in cases of potential miscarriages of justice.
