A judge has stated that determining the father of a child born to a woman who had intercourse with two identical twins within a short timeframe is “impossible.” On the child’s birth certificate, one of the twins was listed as the father, but it was later discovered that either of the brothers could be the father. The other twin and the mother sought to change the parental responsibility arrangement, but the court ruled that the listed father would temporarily lose parental rights until further legal proceedings.
The judge explained that current DNA testing cannot differentiate between the twins to confirm paternity, leaving a 50% chance that the correct father is already listed on the birth certificate. The judge expressed hope that future advancements in paternity testing could provide clarity before the child reaches adulthood.
The judge emphasized that current technology only identifies either of the twins as the potential father without specifying which one. He noted that while it may become feasible in the future to determine the father definitively, the cost and complexity of such testing currently make it impractical. The judge also highlighted that both twins had engaged in sexual activity with the woman around the time of conception, making it equally probable that either of them is the father.
Despite acknowledging the uncertainty, the judge concluded that the listed father’s parental responsibilities would be suspended, though he refrained from definitively ruling out his paternity. He clarified that the lack of concrete evidence does not automatically prove the opposite claim, cautioning against making absolute declarations without substantial proof.
