A man provided multiple disturbing explanations to authorities after sexually assaulting his wife by engaging in anal intercourse against her will.
The individual, aged 43, admitted to forcefully engaging in anal sex with his spouse at their residence in Co Waterford in December 2024. During police questioning, he falsely claimed that his wife had consented to such acts, citing alleged previous instances of consent.
He asserted that although he attempted anal intercourse, he was unsuccessful. Subsequently, the woman underwent a forensic examination, revealing an anal laceration consistent with her accusations. When confronted with her injuries, he insinuated that she might have inflicted the laceration upon herself.
However, his justifications crumbled when he confessed his wrongdoing during the trial while his wife was testifying. Initially, he had asserted the encounter was consensual.
During sentencing, Mr. Justice Paul Burns characterized the rape as a drunken attack by a husband on his wife, exploiting her consent for sexual activity despite her explicit refusal of anal sex. The headline sentence was set at eight and a half years.
The judge expressed skepticism towards the argument that previous consensual anal sex mitigated the severity of the offense. Nonetheless, he considered the perpetrator’s clean record, work history, remorse, and apology to his family. As a result, a seven-year sentence was imposed, with the final year suspended for three years under Probation Service supervision, retroactive to his arrest.
An investigating garda revealed that the couple had been watching a movie and drinking whiskey at home. Despite the woman declining anal sex due to a prior incident, the man proceeded to rape her anally. Following the assault, he fell asleep, leading the woman to discover her injuries and report the incident to the authorities.
Law enforcement officers found the accused still asleep at the crime scene and subsequently arrested him at Dublin Airport upon receiving information about his attempt to flee the country.
The victim chose not to provide a victim impact statement and did not attend court, testifying via video link. The defendant expressed his remorse through a written apology, and his defense counsel emphasized the brief nature of the non-consensual act in the context of previous consensual encounters.
The defense highlighted the timely guilty plea, sparing the victim from cross-examination and demonstrating the accused’s acknowledgment of guilt. They implored the court to acknowledge this factor in sentencing.
