“Labour Proposes Law Change to Safeguard Children”

Labour has introduced plans to protect children from abusive parents by amending existing laws that have been neglected for years under the Conservative government.

Since 1989, judges have been required by law to initially presume that it is beneficial for children to have contact with both parents. However, studies have indicated that this approach can put children at risk of harm.

Although the current legislation includes measures to restrict parental involvement if it endangers a child’s well-being, the government is eliminating this provision. Instead, they are enacting the Courts and Tribunal Bill to prioritize the welfare of children.

The change, advocated for by Claire Throssell in memory of her late children Jack, 12, and Paul, 9, who were tragically killed by their father despite warnings, means that courts will no longer begin with the assumption that parental involvement is always beneficial. The focus will now solely be on the best interests of the child.

If a parent poses a threat to their child’s safety, they can anticipate restrictions on their involvement, such as supervised contact, limited communication, or no involvement at all. Deputy Prime Minister David Lammy stated, “Every child deserves safety, every victim deserves a voice, and every family deserves a justice system they can trust. We must ensure that the tragedy experienced by Claire and her children is never repeated.”

Claire Throssell, MBE and Women’s Aid Ambassador, expressed her gratitude for the repeal of the presumption of parental contact, emphasizing the importance of this change in honor of her sons. She highlighted the significance of preventing children from enduring abuse by those meant to protect them and reiterated the pain of losing her children to violence over a decade ago.
