An elderly woman was forced out of her residence following a legal dispute with a neighbor over a small strip of land. Jenny Field, 77, had her £420,000 bungalow taken away after losing a five-year legal battle involving a boundary disagreement with her neighbor, Pauline Clark, 64. The bungalow located in Poole, Dorset, is set to be sold to cover the approximately £113,000 in legal fees owed to Mrs. Clark.
The court ruled in favor of Mrs. Clark after a prolonged disagreement over a shared fence between the two properties. When court bailiffs arrived at Ms. Field’s bungalow, she reportedly refused to open the door, prompting them to gain entry with the help of a locksmith. Despite Ms. Field’s attempt to explain her situation, she was not allowed back in.
Mrs. Clark’s son-in-law, Matthew Corbin, witnessed the eviction and expressed mixed emotions, stating that while there is relief, the situation is regrettable. Ms. Field was instructed to cover the costs of fence removal and pay two-thirds of Mrs. Clark’s legal fees, totaling around £21,000. Ms. Field claimed that Mrs. Clark had moved the fence onto her property, leading to the legal dispute.
Ms. Field, who bought the bungalow in 2016, expressed distress over being locked out of her home, emphasizing that she had been unfairly treated throughout the prolonged ordeal with her neighbor. Mrs. Clark’s solicitor, Anna Curtis, stated that there had been no attempt to resolve the financial matters outside of court.
In a ruling at Bournemouth County Court, Judge Fentem highlighted the extensive nature of the boundary dispute and Ms. Field’s repeated attempts to challenge the original verdict. The judge concluded that an order for sale was necessary to ensure Mrs. Clark received the funds owed to her, as no other resolution seemed feasible. The order for sale was seen as a final resort to bring closure to the ongoing conflict between the two parties.
