A father and son were reported to have been enraged during a car pursuit that ended in a fatal crash involving a four-year-old child, as disclosed in court proceedings.
Owen Maughan, 27, and his father Patrick Maughan, 54, are facing charges related to the death of young Peter Maughan on June 1 the previous year. The duo made their appearance at Maidstone Crown Court on the current day.
The prosecution detailed that Owen and Patrick had spent the day consuming alcohol in Rochester, Kent, before Owen, under the influence of approximately 12 beers, took the wheel of a Ford Ranger pick-up truck to drive them back home. Patrick had consumed around 13 pints. The court was informed that the drinking session had taken place at the Jolly Knight pub and City Wall wine bar.
While on the A2 motorway, the Maughans encountered Owen’s cousin Hayley, who was traveling in another pick-up truck with her partner Lovell Mahon driving, along with Peter, four, and his younger sister Annarica Maughan. The prosecutor mentioned that for unknown reasons, Owen and Patrick displayed aggression towards the occupants of the other vehicle. Their aggressive behavior escalated as they pursued the family for several miles along the A2 motorway. Hayley recorded video clips of the chase, expressing fear in a voice message to her mother Erica. She later described Peter Maughan as being on the edge.
Upon exiting the A2 at Pepper Hill near Northfleet, it was evident that Owen and Patrick were in a state of rage directed at the occupants of Lovell’s vehicle. Lovell offered to resolve the situation at the Maughans’ residence as they continued the chase. Owen contacted Hayley’s brother Jason, revealing his intention to ram the other truck. Subsequently, Owen veered into the wrong lane and collided with the car at a speed of 60mph. The prosecution emphasized that this action was a deliberate and high-speed ramming, using the vehicle as a weapon to force the other truck off the road. Following the crash, the Maughans fled the scene after Patrick removed the truck’s registration plate. Peter was ejected from the vehicle during the incident and sustained fatal injuries to his head, chest, and abdomen. Despite immediate medical attention, his survival was deemed impossible. Lovell suffered severe injuries, including a skull fracture, and may face permanent mobility impairment.
The prosecution argued that despite being a unique case, the incident qualified as murder, a charge adamantly refuted by the defendants from Hill Rise in Darenth, Kent. Owen Maughan admitted to the manslaughter of Peter Maughan, as well as causing serious harm by dangerous driving and inflicting grievous bodily harm on Mr. Mahon. The prosecutor clarified that Owen acknowledged intentionally ramming the other vehicle and driving recklessly but denied intending harm to the occupants. Patrick Maughan denied any involvement in encouraging or aiding his son, making the defendants’ state of mind during the incident a pivotal aspect of the case.
The trial proceedings were adjourned until the following Tuesday.
