“Arrogant Driver Smirks Outside Court Before Sentencing”

Caught on camera was the demeanor of a driver branded as “arrogant” who caused the death of a young woman, seen smirking outside the courthouse just before being sent to prison.

Dean Tolan, aged 36, was filmed arriving at Sheffield Crown Court for sentencing after admitting guilt in the case involving the fatal accident of 29-year-old Ellie Smart due to reckless driving. The video captured Tolan using a hands-free feature on his phone while displaying a smirk. Additionally, he was observed engaging in light-hearted banter with others and carrying a large overnight bag while awaiting entry into the premises.

Subsequently, Tolan broke down in tears in the courtroom as he received a nine-year prison sentence for the tragic collision in Sheffield on January 25, 2024. He also received a ten-year driving ban. Apart from driving at 58 miles per hour when the incident occurred, hitting Ms. Smart as she was crossing the street, Tolan neglected to wear his prescribed glasses, violating his driving license terms.

Judge Jeremy Richardson KC condemned Tolan, a resident of Birley, Sheffield, for his blatant disregard and arrogance towards the law. The court was informed that Tolan was using his phone just moments before the accident.

In an emotional statement to the court, Ms. Smart’s parents expressed their deep sorrow after witnessing their daughter’s passing shortly after the January 2024 crash.

Ms. Smart, a distinguished graduate in communications who worked at the South Yorkshire Police office, had visited her parents on the morning of the accident. Her parents, residing close by, revealed their decision to leave the city, feeling compelled by the tragic incident.

They lamented the fact that she will never experience marriage, have a family of her own, or witness her niece’s growth.

According to prosecutor Laura Marshall, Tolan disregarded his glasses requirement during the collision, despite the condition on his license mandating their use for driving.

Tolan failed multiple roadside vision tests and falsely claimed to have noticed vision problems only shortly before the accident.

Evidence presented in court indicated that Tolan’s phone was linked to his vehicle’s Bluetooth system, yet records showed usage just seconds before the crash.

Judge Richardson remarked, “Your behavior demonstrated incredible arrogance; you lacked basic humanity when interviewed by the police, attempting to shift blame onto the deceased, the DVLA, and your optician. Your actions led to the demise of a delightful 29-year-old woman with a promising future. You extinguished that.”

The court learned that Tolan even tried to blame Ms. Smart following her death, alleging that she suddenly darted in front of his vehicle, leaving him no time to react.
