A father who beheaded a seagull that snatched one of his daughter’s fries has been sentenced to eight months in jail. Franklin Ziegler was seen holding the decapitated bird and requesting a trash bag at a restaurant near Surfside Pier at Morey’s Piers & Beachfront Waterparks in North Wildwood, New Jersey in July 2024.
Upon police intervention, Ziegler reportedly displayed hostility towards the officers, leading to his arrest and subsequent charge with third-degree animal cruelty. He later pleaded guilty in court, with Judge Jeffrey Wilson acknowledging the 262 days Ziegler had already spent in custody.
In addition to the jail term, the 30-year-old was fined $250. According to the America’s Migratory Bird Treaty Act of 1918, harming seagulls and other migratory birds is prohibited.
Ziegler’s attorney, Jack Tumelty, revealed that his client had entered recovery court due to substance abuse issues. Tumelty stated that Ziegler had been released from Cape May County Jail in February following a guilty plea and was now undergoing outpatient treatment as part of his recovery court probation.
Animal rights advocates criticized the leniency of Ziegler’s sentence. Doll Stanley from the animal rights group In Defence of Animals’ Justice condemned the act as a cruel act of torture committed in public view, emphasizing the need for stronger community protection.
Meanwhile, Barry Fast, who manages a pest control company specializing in seagull control, highlighted the challenges of managing seagull populations due to their persistent behavior around food sources, particularly in outdoor dining areas.
Court records also reveal that Ziegler is facing charges related to assaulting his ex-girlfriend, who is the mother of his child. The incident involved physical violence and confinement, prompting the victim to escape and seek help from law enforcement.
