Watchdog authorities are looking into allegations that certain drivers have been issued parking fines while waiting in line for fuel at gas stations. The Competition and Markets Authority has initiated an investigation into the practices of Euro Car Parks to assess whether their actions at petrol stations and management of appeals could potentially violate consumer protection regulations.
The CMA stated that the probe will evaluate the fairness of imposing parking penalties on drivers while they queue for or utilize petrol pumps and related services like car washes. This scrutiny comes in response to previous reports of motorists facing hefty fines for exceeding their stay at petrol stations, with penalties as high as £100 issued within a short time frame of 20 minutes.
Following agreements between major fuel providers BP and Shell with private parking companies to install surveillance cameras at fuel station entrances and exits, the CMA is also examining Euro Car Parks’ broader appeals procedures concerning both petrol stations and car parks. The CMA emphasized that no conclusions have been drawn yet regarding any potential legal violations by Euro Car Parks.
In a separate development, the CMA imposed a fine of £473,000 on Euro Car Parks earlier this year for failing to comply with a legal notice requiring the provision of information. Euro Car Parks has contested this penalty, which is unrelated to alleged breaches of consumer protection laws.
Amid these actions, the CMA unveiled measures aimed at assisting motorists in dealing with private parking operators to ensure fair treatment when contesting parking charges. Research indicates a significant increase in parking tickets issued by operators at various locations such as gyms, supermarkets, eateries, and retail parks.
Furthermore, the CMA is communicating with private parking operators regarding concerns about the appeals process for drivers and potential unfair surcharges applied during the recovery of unpaid parking fees. The watchdog is urging the sector to align their practices with consumer laws and is providing recommendations to enhance appeals procedures and communication with drivers.
Emma Cochrane, the CMA’s executive director of consumer protection, emphasized the importance of a transparent and equitable appeals process for motorists facing parking charges. The CMA is urging all private parking operators to comply with consumer laws to avoid regulatory action.
Euro Car Parks has been approached for comment, while Lisa Webb, Consumer Law Expert at Which?, expressed support for the CMA’s investigation into Euro Car Parks and highlighted the need for stronger regulations in the private parking industry to protect consumers from unfair practices. Webb emphasized the importance of introducing a robust government-backed code of practice to govern private parking operations effectively.
