A woman has been sentenced to prison for sexually assaulting her daughter and enabling her brother to rape the child, a court heard. Both the woman and her brother, the victim’s uncle, received 15-year jail terms for the crimes. The incident occurred when the woman brought her brother into a room where the child was watching TV and allowed him to commit the rape while she observed. The victim testified that she believed the assault happened on the man’s birthday. The woman, in her 50s, faced 14 charges, including 13 counts of sexual assault and one of rape.
Following an 18-day trial last July, a Central Criminal Court jury found her guilty of two counts of sexual assault between January and September 2001 and the charge of rape in March 2003, when the child was just four years old. The man, in his 40s, also faced charges of rape and was convicted of one count in March 2003.
A third defendant accused of oral rape of the girl had the charges dropped as the Director of Public Prosecutions decided not to pursue another trial. Both the victim’s mother and uncle maintain their innocence and reject the jury’s verdict.
During sentencing, Ms. Justice Eileen Creedon commended the victim for her bravery in coming forward. The judge described the offenses as cruel, egregious, and depraved. She mentioned that the abuse of the child by both offenders was marked by depravity and cruelty. The mother and uncle received a 15-year jail term each, with no reduction for denial, lack of remorse, or desire for rehabilitation.
In a victim impact statement, the woman described the enduring trauma she suffered and the challenges she faced in coping with the abuse. She highlighted her struggle with fear, anxiety, and feelings of worthlessness. The investigating garda confirmed that the remaining children were taken into state care after the mother’s arrest.
The court considered the severity of the offenses, the victim’s vulnerability, and the breach of trust. The defense argued for leniency based on lack of prior convictions and cooperation with the investigation. The woman’s status as a registered sex offender was noted as a significant punishment affecting her reputation. The man’s counsel emphasized his client’s cooperation with authorities and highlighted the dysfunctional environment in which the accused lived.
