“UK Minister’s Single-Sex Space Remarks Draw LGBTQ+ Criticism”

A government minister’s recent remarks on single-sex spaces have sparked criticism from LGBTQ+ advocates, who labeled the comments as “inflammatory and dangerous.” Seema Malhotra, the Parliamentary Under-Secretary of State for Equalities, stated that individuals should intervene if a person of the opposite biological sex mistakenly enters a single-sex facility and alert staff when necessary.

This statement coincided with the release of updated guidance from the Equality and Human Rights Commission (EHRC), affirming that single-sex services should align with biological sex. The new code, issued over a year after a significant Supreme Court ruling in April 2025, clarified that terms like “woman” and “sex” in the Equality Act 2010 refer to biological characteristics.

The revised code addresses various scenarios, such as sports participation based on birth sex rather than gender identity and the lawful exclusion of trans patients from single-sex hospital wards. In response to Malhotra’s remarks, a spokesperson for Trans+ Solidarity Alliance criticized her comments as potentially fueling gender stereotype challenges and contributing to concerns over trans equality and safety.

Malhotra emphasized that trans individuals remain protected under the 2010 Equality Act and should not be deprived of essential services. She highlighted the importance of service providers finding a balance to ensure inclusive, dignified, and privacy-protecting access for everyone, including trans people.

Criticism of the UK government’s approach to trans rights intensified with a joint statement from various LGBTQ+ organizations, expressing deep alarm over the draft Code. The coalition highlighted concerns about potential negative impacts on trans individuals, gender non-conforming individuals, and intersex people, urging the government to prioritize safety and rights over political considerations.

The call for the UK government to address safety concerns for trans individuals traveling to or within the country and to demonstrate a commitment to protecting LGBTQ+ rights indicates ongoing tensions around the interpretation and implementation of policies impacting these communities.
