A judge has been removed from his position after accusations surfaced that he shared a “highly sexualized image” with court staff, despite his assertion that he intended to be friendly. Former solicitor turned district judge, Andrew Simpson, faced an investigation following multiple complaints and was ultimately found guilty of gross misconduct for “abusing his position.”
Allegations against Andrew included engaging in overly familiar and unprofessional behavior by communicating with staff via social media and texts about non-work related matters, as well as sharing photos from social gatherings outside of work, including the purported sexualized image. The investigation was prompted by a complaint accusing the judge of inappropriate conduct towards staff.
During the investigation, Andrew admitted to certain claims but maintained that his actions were not driven by improper intentions. He explained that his interactions were meant to provide support and uplift staff during challenging times. Although he believed he was consistently polite and friendly, he acknowledged that some of his behaviors were inappropriate.
Despite the investigative office acknowledging that Andrew’s intentions were not ill-intended, they deemed his actions as seriously misguided. He was criticized for a significant lapse in integrity and for failing to recognize the power dynamics within the workplace. Initially, a reprimand was recommended considering Andrew’s remorse and assurances that such conduct would not recur, supported by positive references.
However, upon review, Lady Chief Justice Baroness Carr of Walton-on-the-Hill and Lord Chancellor David Lammy overturned the recommendation and dismissed the judge. They cited the repeated nature of his behavior, abuse of his position, distress caused to staff, and the negative impact on the work environment and judiciary reputation.
In a statement, the Judicial Conduct Investigations Office emphasized that Andrew’s conduct was wholly inappropriate, constituting gross misconduct and a severe breach of judicial standards. The office highlighted his lack of insight into the seriousness of his actions and his unfounded challenges to the complaint’s motivations as aggravating factors. As a result, the decision was made to terminate his position as a judicial office holder due to the irreparable nature of his behavior.
