OpenAI has requested a U.S. judge to dismiss over 30 lawsuits filed in California by survivors and families of victims of the Tumbler Ridge school shooting. They argue that legal proceedings should occur in British Columbia instead. OpenAI plans to defend against what they deem as unfounded allegations but believes that the case should be heard in front of a B.C. judge for the benefit of both private and public interests.
The tragic incident on Feb. 10 involved 18-year-old Jesse Van Rootselaar who took the lives of eight individuals, including six children, before ending her own life. Concerns arose regarding Van Rootselaar’s interactions with the health care system and police, particularly related to her use of ChatGPT, which led to scrutiny on OpenAI.
Initially filed in California, the lawsuits accuse OpenAI and CEO Altman of negligence in preventing the shooting. Allegations suggest that OpenAI was aware of the shooter’s intentions through ChatGPT but chose not to alert authorities. Claims include holding Altman and OpenAI responsible for producing a dangerous tool, disregarding safety warnings, and prioritizing profits over lives.
OpenAI has been filing motions to dismiss these lawsuits under the legal principle of “forum non conveniens,” asserting that British Columbia is the appropriate venue due to the evidence and witnesses being primarily located there. They argue that B.C. has a vested interest in resolving the actions locally, as they involve Canadian law enforcement and regulations.
Regardless of the legal venue, OpenAI intends to contest the accusations, stating that blaming them for the shooting is not legally sustainable. Altman, who was not directly involved in the decisions regarding the shooter’s account, also intends to defend against the claims. Following public backlash, Altman apologized to the Tumbler Ridge community and announced updated company protocols.
Moreover, the B.C. government is preparing legal action against OpenAI, and the Tumbler Ridge Secondary School site has been demolished in the aftermath of the tragic incident.
