“Police Officers Not Charged in Death of Man in Boston”

Seven police officers involved in restraining a man who later died will not be charged with any criminal offenses, officials have confirmed. The incident took place in a suburb of Boston, Massachusetts, where 43-year-old Francis Gigliotti passed away outside a fish market on July 11. Mr. Gigliotti, who was reportedly experiencing a mental health crisis, was restrained by officers after walking into traffic. Despite not wearing body cameras, witnesses’ videos depicted multiple officers holding Mr. Gigliotti face down as he expressed distress.

Additional footage from local media displayed Mr. Gigliotti falling, hitting his head, and nearly being struck by vehicles. Following the incident, the seven officers were placed on leave pending an investigation, which concluded with the decision not to pursue criminal charges.

Essex District Attorney Paul Tucker stated that after a thorough review of the facts and expert opinions, there was insufficient evidence to support criminal charges against the officers. Mr. Tucker highlighted that Mr. Gigliotti’s autopsy revealed cardiac dysrhythmia due to a combination of cocaine and ethanol intoxication while being restrained by the police, with no signs of physical trauma on specific body parts. The officers attempted to assist Mr. Gigliotti initially before restraining him when he appeared to pose a danger to himself and others.

Despite the lack of criminal charges, the family’s attorney expressed disappointment but vowed to seek justice and accountability for the Gigliotti family. The U.S. Department of Justice has long cautioned against prone restraint due to the potential risks of asphyxia, emphasizing the importance of promptly moving restrained individuals off their stomachs to prevent harm.
