A woman in her 50s residing near Chesterfield, Derbyshire, faced legal repercussions for an unpaid £35 car tax bill related to her deceased husband’s vehicle. Despite explaining her situation in a letter to the court, stating that she did not drive, had never owned a car, and inadvertently overlooked the tax payment during the period of mourning and funeral arrangements, she was convicted through a swift judicial process known as the Single Justice Procedure (SJP).
The widow, who chose to remain anonymous, detailed in her letter to the court that she was emotionally distressed and overwhelmed at the time of the offense. She clarified that she was not familiar with vehicle tax regulations, faced language barriers, and struggled to comprehend official documents, leading to confusion regarding the tax obligations of the vehicle she inherited after her husband’s passing.
Following her guilty plea submitted in writing, the magistrate, Dawn Towart, imposed a six-month conditional discharge and ordered her to cover £85 in court costs in addition to the initial £35.84 tax bill. Instead of referring the case back to the DVLA for reconsideration, the magistrate proceeded with the conviction and sentencing.
The DVLA expressed support for reforming the SJP process to ensure that mitigating circumstances, as outlined in letters to the court, are duly considered by prosecutors. Despite a government consultation on potential system changes, no actions have been taken since seeking feedback on reform a year ago.
During a recent press conference, Lady Chief Justice Baroness Sue Carr addressed concerns about the transparency and outcomes of the SJP, disclosing a review of the system conducted by a senior judge. While the results of the audit were not disclosed, she emphasized that the judiciary applies the law within its scope, leaving operational decisions to policymakers.
