“Family Seeks Damages After Tragic Playground Accident”

The family of a three-year-old boy who tragically lost his life in a playground accident has initiated legal action to claim emotional damages.

Kaleb Ortega sustained fatal injuries when a structure hit him on April 1 at Rooks Park in Walla Walla, situated in southern Washington State close to the Oregon border.

According to the lawsuit, Kaleb, accompanied by his father and five-year-old sister, was at the park when the monument collapsed suddenly, resulting in his tragic death. He was swiftly taken to the hospital by first responders, where his mother, a nurse, was on duty. Regrettably, he succumbed to his injuries at the medical facility.

His devastated parents, Claudia and Miguel Garcia, have filed a lawsuit against multiple companies involved in the construction of the monument, alleging that the landmark was not adequately safe.

Rooks Park, the site of the incident, is a public recreational area in Walla Walla County managed by the US Army Corps of Engineers. The monument honored Captain Albert H. Rooks and the USS Houston CA-30.

Following Kaleb’s passing, the park was closed for a fortnight to prevent similar incidents and as a mark of respect.

A GoFundMe page established for his family recounted the tragic events of April 1, describing it as an unforeseen accident that took Kaleb prematurely.

Kaleb was remembered as a vibrant and active young boy who brought joy to every moment of his life. The page highlighted his love for playing, exploring, and being with his older sister, whom he considered his closest companion.

The lawsuit, filed in Walla Walla County Superior Court, names several companies as defendants, accusing them of negligence in the monument’s design or lack of adequate warnings.

The family is seeking emotional damages due to the trauma experienced by Kaleb’s family members at the scene of the accident.

As of now, the defendants have not responded to the lawsuit.
