“Family Seeks $18M in Lawsuit Over Toddler’s Fatal Fall”

The family of a young child who tragically fell from a high-rise apartment in North York is taking legal action against the building owners and management, seeking millions in compensation. The lawsuit, filed in August at the Ontario Superior Court of Justice, alleges that negligence by GH Capital Corporation, 373041 Ontario Limited, and two property managers led to the fatal incident at 50 Graydon Hall Drive.

According to the statement of claim, the toddler was playing with her parents inside the apartment when she inadvertently touched a bedroom window, causing it to break suddenly, leading to her fall and subsequent death. The parents were close by but could not prevent the accident, witnessing their child’s fatal fall and suffering severe and lasting psychological injuries.

The plaintiffs, including the parents and grandparents, are seeking $18 million in damages for the tragic loss and the emotional trauma endured. The lawsuit highlights the alleged failure of the management to provide safe and properly maintained windows, citing instances of negligence such as the absence of safety locks and inadequate glass maintenance.

The legal representative for the family emphasized the importance of raising awareness about safety in apartment buildings, pointing out that no amount of money can compensate for the devastating loss. The lawsuit also accuses the defendants of making unfounded insinuations about the family’s integrity in connection with the incident. The claims made in the lawsuit have not yet been subjected to legal scrutiny.

The family continues to suffer from depression, anxiety, and traumatic flashbacks following the tragedy, as detailed in the legal document. The lawsuit seeks punitive damages, alleging that the defendants exploited the family’s grief and unfairly cast suspicion on them without valid grounds.

CBC News attempted to reach out to GH Capital Corporation and the defendants’ legal representatives for comments, but responses have not been received at this time.
