Dorothy Cook dedicated herself to caring for her husband, Melvin, who was diagnosed with a rare brain disease after 49 years of marriage. Despite her commitment, Dorothy faced a hurdle when a doctor refused to discharge Melvin from the hospital due to the absence of a power of attorney document.
Power of attorney is a legal instrument that authorizes a trusted individual to make financial, property, or health decisions on behalf of another person. Dorothy, a 68-year-old from Bristol and a former occupational psychologist, had to leave her business to become a full-time caregiver to Melvin, who suffered from ataxia, a degenerative brain disorder affecting movement and communication.
During a hospital admission in March 2025, a doctor deemed Melvin lacking mental capacity, preventing his discharge. Dorothy clarified that Melvin’s communication challenges, not cognitive capacity, caused this assessment. Without being present at the evaluation, Dorothy couldn’t address these communication issues initially.
Eventually, Dorothy proved her capability to care for Melvin, allowing his discharge. Failure to demonstrate this could have led the hospital team to override her decisions legally. Melvin, a former successful engineer, succumbed to ataxia at 78 in June 2025, prompting Dorothy to share her experience on the significance of power of attorney on the inaugural nationwide Power of Attorney Day.
Reflecting on their challenging journey, Dorothy emphasized the importance of having a power of attorney in place to avoid the distress they endured. She established power of attorney post-discharge and encourages others to take similar action. Carers UK and Standard Life collaborated to launch the UK-wide Power of Attorney Day, aiming to raise awareness as only 8% of adults possess updated power of attorney documents.
Helen Walker, CEO of Carers UK, stressed the unpredictability of life and the need for proactive planning. Claire Hawkins, Director at Standard Life, highlighted the critical role of power of attorney in safeguarding finances during unexpected life events. Their joint effort aims to ease the legal processes faced by families in times of crisis, underscoring the importance of early preparation.
